ABOUT Andrew B. Kleiner
Andrew is senior counsel in WSHB’s Phoenix Office. Andrew’s practice focuses on providing clients with strategic business advice on labor and employment issues, managing and resolving pre-litigation employment claims, and litigation management for employers in state and federal court. Andrew also counsels employers on matters related to wrongful discharge, retaliation, harassment, discrimination, wage and hour compliance, and employment agreements. Andrew has defended employers in single plaintiff and collective or class-action matters, including Private Attorney General Act (PAGA) claims. Andrew is experienced in representing employers in response to NLRB complaints of unfair labor practices under the National Labor Relations Act, which applies to all workplaces regardless of union representation. He further advises his clients about employee discipline, investigations, terminations, layoffs, and preventative measures such as training, policies and handbooks. Andrew also regularly appears before administrative agencies defending employers and engaging in early resolution.
In addition to his employment practice, Andrew has extensive experience representing a wide array of clients from individuals to Fortune 100 corporations in business disputes and general liability matters, including products liability, premises liability, workplace and construction site accidents, trucking incidents, wrongful death, and other catastrophic injury cases involving serious injuries. Andrew is experienced in all aspects of civil litigation, having successfully mediated cases and received many favorable final judgments in favor of his clients through summary judgment in both state and federal courts.
In addition to litigation, Andrew routinely performs corporate transactional work. He has formed corporations and LLCs for businesses who are growing or need to restructure to adapt to compliance and profitability concerns. His experience includes drafting bylaws, resolutions for officers and board of directors, and employment agreements.
