ABOUT Chanel A. Mosley
Chanel is a shareholder in the Health Care Department, and devotes her practice to the representation of hospitals, physicians, long-term care facilities, and other health care providers in the defense of claims involving medical malpractice, nursing home negligence and other health care matters. Chanel also handles a variety of premises and general liability claims.
Prior to joining Marshall Dennehey, Chanel worked as a defense attorney at a national insurance defense firm where she focused her practice on health care litigation. She also spent six years as a paralegal in insurance defense prior to becoming an attorney. Chanel graduated, cum laude, from the University of Central Florida with a bachelor's degree in Accounting. She received her J.D. from Barry University Dwayne O. Andreas School of Law, where she served as a legal research and writing teaching assistant and was an elected member of the Student Bar Association.
Chanel is a member of the Florida Bar, Orange County Bar Association, Central Florida Medical Malpractice Claims Council and Florida Society for Healthcare Risk Management and Patient Safety. She served four years on the Board of Directors for the Young Lawyers Section of the Orange County Bar Association, and from 2014-2015 was the board's Communications Coordinator. Currently, Chanel serves as co-chair of the Conference Planning Committee for the Florida Society for Healthcare Risk Management and Patient Safety.
In 2014, Chanel received recognition as a Florida Legal Elite Up and Comer, and from 2016 to 2019, she was selected as a Florida Super Lawyers Rising Star in the category of health care.

Appellate court affirms dismissal of claims against Florida acute care hospital.

We obtained an appellate decision affirming the dismissal, with prejudice, of a wrongful death lawsuit filed against a long-term acute care hospital in Florida. The claim alleged the hospital improperly transferred the patient to another hospital without an adequate handoff and appropriate medications, resulting in the death of the patient shortly after arrival at the receiving hospital. The plaintiff sought damages for medical negligence and intentional infliction of emotional distress.
Optometrist Not Liable for Patients Glaucoma

Obtained summary judgment on behalf of an optometrist in a medical malpractice case. The plaintiff alleged that she was neither informed of the elevated pressures in her eyes nor referred for a glaucoma evaluation by our client. She was later diagnosed with glaucoma and sought damages for permanent eye injuries, asserting that our client deviated from the professional standard of care.

In 2014, the Florida Supreme Court held that caps on non-economic damages in medical malpractice actions violate the equal protection clause and are unconstitutional. Estate of McCall v. United States, 134 So. 3d 894 (Fla. 2014).
Florida Supreme Court rejects statutory changes to 90.702 and 90.704, Fla. Stat. to the extent they are procedural, apparently reverting back to Frye standard for admissibility of scientific evidence.
