ABOUT Ms. Virginia Mixon Swindell
Virginia Mixon Swindell is a Principal in the Houston, Texas, office of Jackson Lewis P.C. An experienced advocate representing employers, Ms. Swindell focuses on identifying practical solutions for her clients’ workplace law challenges, both in the courts and in the office.
Ms. Swindell represents employers in state and federal courts who are facing class, collective and individual employment law disputes, such as claims of discrimination, harassment, whistleblower retaliation, wage and hour violations, leave and disability accommodation issues, and breaches of contract. Ms. Swindell also defends employers in administrative agency proceedings before the DOL, the EEOC and OSHA. In addition, Ms. Swindell conducts internal investigations of allegations made by and about employees at all levels, from executives to entry level workers. Ms. Swindell’s early career experience representing corporate clients in complex commercial litigation, international arbitration, and civil enforcement proceedings before the SEC and CFTC, provides her a uniquely broad perspective on her clients’ operations and the potential business impact of employment disputes.
In addition to advocating for clients who confront legal claims, Ms. Swindell avidly enjoys helping her clients prevent lawsuits. She counsels employers regarding human resources challenges and risks, including in the hiring process, background checks, drug testing, discipline and performance management, wage and hour compliance, compensation, disability accommodation and leave management, and terminations. Ms. Swindell assists employers with the preparation and review of codes of conduct, employment handbooks and policies, job descriptions, and employment contracts. When economic conditions require, Ms. Swindell partners with her clients to provide legal advice regarding furloughs, reductions in force, and other cost-saving measures, including analysis of selection criteria and WARN act requirements.
In her first year as a licensed attorney, Ms. Swindell completed a judicial clerkship with the Honorable Carolyn Dineen King of the United States Fifth Circuit Court of Appeals. While attending law school, she was an Articles Editor on the Houston Law Review and she completed an internship with the Honorable Lee H. Rosenthal of the United States District Court for the Southern District of Texas.
