ABOUT Rosalind B. Herschthal
Rosalind is a member of the Health Care Department. An experienced trial attorney with a nursing degree, she concentrates her practice on medical malpractice, long-term care liability, medical technology, and pharmacology defense.
Rosalind devotes a significant portion of her practice to defending hospitals, nursing homes, long-term acute care hospitals, sub-acute facilities and skilled nursing facilities in liability matters, and she has successfully obtained numerous defense verdicts on behalf of her clients.
Rosalind graduated cum laude from SUNY Medical Center in Brooklyn, New York, with a degree in nursing. She worked as a nurse at New York University: Rusk Institute of Rehabilitation Medicine and then at Mt. Sinai Hospital in Miami, Florida, while attending law school at the University of Miami School of Law. Graduating with honors, cum laude, Rosalind received her juris doctor in 1981.
Rosalind has conducted several seminars on nursing home litigation and hospital and health care liability for various Florida hospitals and New Jersey organizations, such as the Association of Trial Lawyers of America. She was a guest lecturer for the New Jersey ICLE program and she has presented long-term care seminars for numerous clients and attorneys within the firm.

Defense Verdict for Internist

Obtained a defense verdict in a medical malpractice action regarding alleged negligence and informed consent in a four-week trial in Bergen County, New Jersey. The plaintiff alleged that our client, an internist, negligently prescribed an iron infusion to a 52-year-old man with severe anemia (from newly diagnosed colon cancer). During the test dose of the iron, the decedent had a reaction that was unobserved by the nurse, which continued until the decedent had a cardiac arrest. He was resuscitated, but he died a day later.

Defense verdict in a health care liability case following a six-week jury trial where the demand was $12 million at the onset of trial. The plaintiff, a 44-year-old woman, claimed our internal medicine physician was negligent in failing to order a spinal tap after a six-day period of the plaintiff having a fever and severe headaches, in addition to an upper respiratory virus.
Jury Sides With Defense in Complex Medical Malpractice Trial

Obtained a defense verdict after a five-week medical malpractice trial in New Jersey. The plaintiffs alleged that our clients, an emergency medicine physician and a nurse practitioner, failed to diagnose and test for a subarachnoid hemorrhage (brain bleed) in a patient who came to the Emergency Department with a non-traumatic nosebleed and hypertension. When she arrived at the ER, the 59-year-old plaintiff was evaluated by the nurse practitioner, who performed a full exam of the patient and treated the nosebleed with nasal packing.
